Agreement to Terms

By accessing and using PowerDialer Pro (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Service Description

PowerDialer Pro is a multi-line dialer and SMS platform that enables users to:

• Make multiple simultaneous outbound calls
• Send high-volume SMS campaigns
• Manage contact lists and call dispositions
• Track campaign performance and analytics
• Integrate with CRM and other business tools

User Accounts

To access the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Be at least 18 years old to use the Service

Acceptable Use Policy

You agree to use PowerDialer Pro only for lawful purposes and in compliance with:

• All applicable federal, state, and local laws
• Telephone Consumer Protection Act (TCPA) regulations
• CAN-SPAM Act for email and SMS communications
• Industry best practices and ethical standards
• Our platform usage guidelines

Prohibited Uses

You may not use PowerDialer Pro for:

• Harassment, threats, or abusive communications
• Fraudulent or deceptive practices
• Violation of privacy rights or data protection laws
• Spam, unsolicited communications, or cold calling without consent
• Any illegal or unauthorized purpose
• Attempting to gain unauthorized access to our systems

Payment Terms

• Subscription fees are billed monthly or annually in advance
• Usage-based charges (SMS, minutes, numbers) are billed monthly
• All fees are non-refundable except as required by law
• You authorize automatic billing for ongoing services
• Failure to pay may result in service suspension
• Price changes will be communicated 30 days in advance

Data and Privacy

Your data privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your information. You retain ownership of your data and grant us necessary rights to provide the Service.

Intellectual Property

PowerDialer Pro and its original content, features, and functionality are owned by WC Investments Solutions LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect service availability. We will provide advance notice when possible.

Limitation of Liability

To the maximum extent permitted by law, WC Investments Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease, and you remain responsible for all fees incurred up to the termination date.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

Terms Updates

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
